The SBI has completed the investigation of the People's Deputy of Ukraine who committed a fatal road accident in Zhytomyr region
The employees of the SBI have completed the investigation of the criminal proceeding against the People's Deputy of Ukraine, who committed a fatal road accident in Zhytomyr region.
The incident happened on the Kyiv-Chop highway in the Berezivka village, Zhytomyr district, at about 10:00 AM on November 3rd, 2023.
A car driven by the People's Deputy ran into the pedestrian. It was established that the People's Deputy, contrary to the requirements of the traffic rules, was driving from the capital to Lviv with exceeding the speed limits. In particular, speed cameras on the Kyiv-Chop highway recorded an excess of the permissible speed from 40 to 50 km/h, including the fact that one of the cameras recorded such an excess within the village where the tragedy occurred. This was confirmed by photo- technical expertise.
At that time, an 18-year-old local resident was running across the road in the village. The driver, by exceeding the permitted speed, hadn’t taken enough measures to reduce the speed until the vehicle stopped and allowed to run over the victim. The girl died from her injuries at the scene.
The investigation established that the driver's compliance with the requirements of the traffic rules regarding driving at a permissible speed of no more than 110 km/h and timely braking would have enabled the victim to leave the roadway.
It also became known that the perpetrator was systematically brought to administrative responsibility by the patrol police for speeding, in particular, only during 2022-2023 22 decisions were made against him to bring to administrative responsibility under Part 1 of Article 122 of the Code of Ukraine on Administrative Offenses.
The People's Deputy of Ukraine is suspected of violating the rules of road safety by a person driving a vehicle that caused the death of the victim, that is, in committing a criminal offense under Part 2 of Article 286 of the Criminal Code of Ukraine.
The sanction of the Article provides imprisonment for up to 8 years.
Currently, the investigators of the SBI have opened the materials of criminal proceedings for familiarisation.
The procedural guidance is provided by the Office of the Prosecutor General of Ukraine.
