The SBI completed the investigation against the judge from Dnipro, who illegally appropriated his rented apartment
The employees of the State Bureau of Investigation have completed an investigation against the judge of the Babushkinsky District Court of Dnipro, who illegally appropriated an apartment in the historic center of the city.
The indictment was sent to the court.
According to the investigation, the judge had rented the apartment, but after two months he stopped paying the rent and did not allow the owner to enter her apartment. At the same time, he applied to another district court of Dnipro with a civil lawsuit demanding to recognize his ownership of the property. A colleague of the suspect satisfied the lawsuit and recognized the apartment as his property.
As an evidence, the court used a fake receipt from the owner of the apartment, which allegedly confirmed that she had received UAH 412 thousand for the sale of the apartment. However, the woman said that she had not received any money and had not signed any documents. A handwriting expertise confirmed her words: the signature on the receipt was forged. Another expertise found that the real market value of the apartment was over UAH 1 million.
In addition, during the searches, the judge's mobile phone with data that confirms the fact of illegal seizure of real estate, among other things, was seized.
The judge is accused under Part 2 of Article 384 of the Criminal Code of Ukraine (misleading the court) and Part 5 of Article 190 of the Criminal Code of Ukraine (fraud on a large scale).
The sanction of the articles provides for imprisonment for up to 12 years with confiscation of property.
At the request of the SBI, the High Council of Justice suspended him from administering justice and granted permission to keep the judge in custody.
Procedural guidance is provided by the Office of the Prosecutor General.
